Calvert County Register of Wills Office

Hon. Margaret H. Phipps serves as the Register of Wills for Calvert County. The office is in the Courthouse at 175 Main Street in Prince Frederick. Staff handle estate openings, will filings, bond processing, and account reviews. Appointments are recommended before you arrive. The office accepts documents through a black drop box at the main entrance sidewalk, next to the billboard. This is handy if you need to leave papers outside of regular hours. All visitors who enter the Calvert County Courthouse must go through a security search. The Orphans' Court meets at the same address and has jurisdiction over contested estate matters, guardianships, and the oversight of personal representatives in Calvert County.

Calvert County Estate Records

Calvert County was created on July 3, 1654, from parts of Charles and Anne Arundel Counties. It is named for Cecil Calvert, the 2nd Baron Baltimore. The Register of Wills office has records beginning in 1882. Wills on file start in 1882, and general probate records span from 1882 to 1989 in the historical collection. Earlier records are at the Maryland State Archives, also known as the Hall of Records, in Annapolis.

Modern probate court records in Calvert County include wills, petitions for probate, inventories, information reports, administration accounts, bonds, and letters of administration. Under Md. Code, Estates and Trusts § 7-101, the personal representative files an inventory within three months. The list of interested persons is due within 20 days per § 7-104. The first account must be filed within nine months of appointment. Each of these documents becomes part of the permanent probate record in Calvert County.

Probate Court Records and Filing Fees

Opening an estate in Calvert County starts at the Register of Wills office. Bring the original death certificate, the original will if there is one, a funeral bill or contract, and bank statements for the person who died. You also need vehicle titles, property information, stock details, and the names and addresses of all heirs. The staff will help you fill out the forms.

Fees are set by the state of Maryland based on estate value. No fee is charged for estates worth $50,000 or less. The fee is $100 for estates from $50,000 to $100,000 and $200 for estates up to $500,000. Higher-value estates pay more, up to $10,000 plus a small percentage for estates over $10,000,000. Under Md. Code, Estates and Trusts § 5-601, small estates valued at $50,000 or less can use a simplified process. The threshold rises to $100,000 if the surviving spouse is the sole heir.

Once the estate opens, creditors must be notified. They have six months from the date of death to make claims per § 8-103. The personal representative publishes this notice in a Calvert County newspaper. A first account of the estate is due within nine months. The Orphans' Court in Prince Frederick reviews all accounts before the estate can close and assets can be distributed to heirs.
