Fees for Cecil County Probate Filings

The cost to open an estate in Cecil County depends on the value of the assets. Maryland sets these fees by state law. Estates worth $50,000 or less pay no fee. Estates between $50,000 and $100,000 pay $100. For estates from $100,000 to $500,000, the fee is $200. Larger estates pay more, up to $10,000 for estates over $7.5 million. These rates took effect on October 1, 2022.

Under Maryland Estates and Trusts Code § 5-601, small estates worth $50,000 or less can use a faster process. If the only heir is a surviving spouse, the cap goes up to $100,000. This small estate path cuts down on paperwork and time. The personal representative files a petition and a list of assets and debts. There is no bond needed for estates under $10,000 in Cecil County.

For regular estates, the personal representative must file an inventory within three months under § 7-101. An information report is also due in that same window. The first account must be filed within nine months. Creditors have six months from the date of death to make claims per § 8-103. These rules apply to all Cecil County probate court records.
