Garrett County Probate Court Records Available
Garrett County was carved from Allegany County in 1872. It is the youngest county in Maryland. Probate court records start at that year. The collection includes wills from 1873 to 1926 and a second set from 1897 to 1940. Estate records span 1873 to 1999. The Maryland State Archives holds these older records on microfilm and in their vault.
Current probate court records in Garrett County include everything filed when someone dies with assets in the county. The personal representative files a petition to open the estate. Under § 5-102, Maryland has two types of probate: administrative and judicial. Administrative probate is for cases with no disputes. The Register of Wills handles these. Garrett County Estate Filing Fees

The cap rises to $100,000 when the sole heir is a surviving spouse. This means less filing and a faster close. Regular estates have more steps. The personal representative must file a list of interested persons within 20 days under § 7-104. An inventory is due in three months per § 7-101. The first account comes due within nine months. Creditors get six months from the date of death to file claims per § 8-103. Most estates in Garrett County settle within 9 to 18 months.
