Montgomery County has a unique arrangement for its Orphans' Court. Unlike most Maryland counties, Circuit Court judges sit as Orphans' Court judges in Montgomery County. This means the same judges who handle civil and criminal matters also hear contested probate cases. Under Estates and Trusts Code Section 2-101, the Orphans' Court has jurisdiction over judicial probate and estate administration. For routine estates, the Register of Wills handles the process without a court hearing. Germantown residents only need to go before the court if someone contests the will or disputes the personal representative's actions.

The office currently operates by appointment only, with a maximum of two persons per visit. This policy has been in place since the pandemic and remains active. Probate Records Types and Fees

When a Germantown resident's estate goes through probate, several types of records get created. The will is filed first. Then the Register of Wills issues letters testamentary or letters of administration. The personal representative must file an inventory within three months per Section 7-101. A list of interested persons is due within 20 days under Section 7-104. Accounts and a final distribution report follow. Each of these becomes part of the permanent probate court records file.

Maryland probate fees are based on estate value. Estates under $50,000 pay no filing fee. The fee for estates worth $50,000 to $100,000 is $100. Estates from $100,000 to $500,000 cost $200 to file. Given property values in Germantown and the Montgomery County area, many estates will fall in the higher brackets. Estates worth $500,000 to $1,000,000 pay $1,000, and those above $1,000,000 pay $2,000 or more. Small estates under $50,000 qualify for a simplified process under Section 5-601.
