Probate Filing Process in Rockville

When someone in Rockville dies with a will, the original must be filed at the Register of Wills office. Do it promptly. The named personal representative files a petition to open the estate. Without a will, a family member can apply under Md. Code, Estates and Trusts 5-104. The statute sets a priority list for appointment.

Administrative probate handles most Rockville cases. The Register reviews the paperwork, appoints the personal representative, and issues Letters of Administration. No court hearing is needed. Judicial probate through the Orphans' Court is reserved for contested cases. A caveat, which is a formal challenge to the will, triggers judicial probate. So does a dispute over who should serve as personal representative. These cases take longer and usually need a lawyer.

Once appointed, the personal representative has several deadlines. A list of interested persons is due within 20 days. The inventory of estate assets must be filed within three months under Estates and Trusts 7-101. An information report is also due within three months. Creditors get six months from the date of death to file claims. The first account is typically due within nine months. All of these documents become part of the Rockville probate court record.

Note: Modified administration lets eligible estates close within 12 months when all heirs agree and there are no disputes.

Rockville Probate Fees and Costs
