Opening an Estate for Wheaton Residents

When a Wheaton resident dies, the process to open an estate begins at the Montgomery County Register of Wills. The first step is filing the original will, if one exists, along with a petition for probate. Maryland law under Md. Code, Estates and Trusts § 4-202 requires that a will be filed promptly after death. There is no strict deadline written in the code, but courts expect it done without unreasonable delay.

The Register of Wills reviews the petition and appoints a personal representative. That person takes charge of the estate. They must file a list of interested persons within 20 days, an inventory within three months, and an information report within three months. These deadlines are set by Md. Code, Estates and Trusts § 7-101 and related sections. The first account of income and expenses is due within nine months. All of these filings become part of the probate court records for that estate.

Creditors get six months from the date of death to file claims, per Md. Code, Estates and Trusts § 8-103. The personal representative must publish a notice in a local newspaper to let creditors know. After debts are settled and all accounts filed, the estate can be closed with a final account.

Wheaton Probate Fees and Costs

Maryland probate fees apply statewide. They do not change from county to county. Wheaton residents pay the same fees as everyone else filing at the Montgomery County Register of Wills. The fee is based on the total value of the estate being probated.

Estates worth $50,000 or less pay nothing. Between $50,001 and $100,000, the fee is $100. Estates from $100,001 to $500,000 cost $200 to file. Above that, fees jump to $1,000 for estates up to $1 million and keep rising. For very large estates over $10 million, the fee is $10,000 plus 0.02% of the amount above $10 million. These are the Register of Wills fees only. You may also need to pay for things like newspaper publication, bonds, and certified copies of Wheaton probate court records.

Small estates get a faster path. Under Md. Code, Estates and Trusts § 5-601, estates under $50,000 can use a streamlined process with fewer forms. If the surviving spouse is the sole heir, that limit doubles to $100,000.

Filing Wheaton Probate Documents Remotely

This is useful for Wheaton residents who want to avoid the trip to Rockville or who have scheduling conflicts. You can mail documents to the office at 50 Maryland Avenue, North Tower, Rockville, MD 20850. You can also drop them in the courthouse dropbox on Maryland Avenue, which is checked during business hours.

For documents under 25 pages, you can email them as a PDF to MontgomeryCountyRow@registers.maryland.gov. Larger filings need to go by mail or in the dropbox.
